Vegas Flyaway Sweepstakes from Vivax Pro Painting

Eligibility: The Vivax Pro Painting Contest is open only to legal residents of the 50 United States (and the District of Columbia) who are at least 21 years old at the time of entry. Employees of Vivax Pro Painting, as well as the immediate family are not eligible. Subject to all federal, state and local laws and regulations.

Agreement to Official Rules: By participating in the Contest, each entrant unconditionally agrees to and accepts these Official Rules, which are final and binding in all matters related to the Contests.

Drawings: The Grand Prize Drawing will be conducted in accordance with these Official Rules on November 15, 2011. The random drawing will be conducted from amongst all eligible entries received in accordance with these Official Rules and the selection of potential winners are final and binding. Entrants selected must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. The potential winner will be notified by phone and email.

Alternate Value: If for any reason, the winner cannot go, or does not want to go on the trip, Vivax Pro Painting will pay the winner $500 per trip (2 separate trips will be sponsored by Vivax Pro Painting).

Publicity: Except where prohibited, participation in the Contests constitutes winner’s consent to Vivax to use winner’s name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further notice, payment or consideration.

General Conditions: If we painted your house and you supplied at least 1 valid referral that had their house painted by Vivax, you will be entered into the drawing. There is no limit on the number of entries you can have. The contestant with the most entries by November 15, 2011 will automatically win one drawing. Contest dates: August 1, 2010–August 1, 2011.

Release: By entering this Contest, entrant agrees to release and hold harmless, Vivax Pro Painting from and against any claim or cause of action arising out of participation in the Contests or receipt or use of any prize.

Limitations of Liability: Contests shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: (a) participation in this Contest; (b) human error; (c) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software, delay in operation or transmission, communications line failure, technology outage, theft or destruction or unauthorized access to, or alteration of entries, whether caused by the sender or any of the equipment or programming associated with or utilized in the Contests; (d) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (e) unauthorized human intervention in any part of the entry process or the Contests; (f) electronic or human error which may occur in the administration of the Contests or the processing of entries; (g) acceptance/possession, use/misuse, and/or defects of prize or prize component; or (h) any injury or damage to persons or property, including but not limited to entrant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contests. Entrants further agree to indemnify and hold harmless the Contests from any and all liability resulting or arising from the Contests, to release all rights to bring any claim, action or proceeding against the Contests Entities.

Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with the Contests, or any prizes awarded, other than the administration of the Contests or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contests but in no event attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of the entrant and Sponsor in connection with the Contests, shall be governed by, and construed in accordance with, the laws of the State of Colorado, without giving effect to such State’s conflict of law rules.
